Terms of Service

When dealing with photo and video services, there are a few key pieces of information that i’ve got to outline:

PHOTO TERMS OF SERVICE

Images are archived for each project for a MINIMUM of 3 years.  Rights and usage of images remain with the PHOTOGRAPHER for the life of the images unless alternative parameters are agreed upon via written contract prior to invoice close.

Raw images are not included in every invoice.  Unless agreed upon via package selected or written contract prior to invoice close, raw images will not be provided without monetary consideration.

Duplication services are not included unless agreed to prior to invoice close.  If duplication is requested after invoice close, it may be provided at the client’s request for an additional fee.

VIDEO TERMS OF SERVICE

Video projects are stored for 60 calendar days after invoice close unless agreed to via written contract prior to invoice close.  After that window, files are deleted or archived for possible later promotional usage.

Duplication services are not included unless agreed to prior to invoice close.  If duplication is requested after invoice close, it may be provided at the client’s request for an additional fee.

All rights to footage captured and usage are that of the PRODUCER unless agreed upon via written contract.  Rights and usage of the final edited files are that of the CLIENT.

Unless agreed upon prior to invoice close, raw footage is not included in invoice pricing.  If you’d like to have all of the raw footage of your project, I store projects for 60 calendar days after invoice close.  The cost for raw footage is $1,000 per hour of shooting, agreed upon via written contract prior to the 60 day window’s close.

Once the invoice closure window has passed, no other use of the project is anticipated, nor have terms of consideration been agreed upon to for any but the use specified therein outside of promotional usage by the PRODUCER.

 

If no written contract was signed, adherence to these terms is required at invoice close.
